General terms of sale

The present general conditions of sale aim to define the contractual relations between, on the one hand, the brand Sabotage Skateboards®, hereinafter referred to as "the Seller", and on the other hand, any individual wishing to make a purchase via the internet site www.sabotage-skateboards.com, hereinafter referred to as "the Buyer".

The acquisition of a product through this site implies the Buyer's unreserved acceptance of the entirety of these general terms and conditions of sale, which he or she acknowledges having read prior to placing an order. These conditions prevail over any other general conditions of sale unless expressly accepted by the Seller.

Sabotage Skateboards® reserves the right to modify these terms and conditions of sale at any time, in order to comply with any new regulation or in order to improve the use of its site. Therefore, the applicable conditions will be those in force at the date of the order by the Buyer.

Order

The articles visible on the site are available while stocks last. In the event of debit or collection of an order for an unavailable item, Sabotage Skateboards® undertakes to offer a credit note or to reimburse the Purchaser within 45 days. Sabotage Skateboards® undertakes to notify by e-mail the Buyer who has placed an order for an unavailable item.

Prices and payment terms

The prices applicable to orders are those displayed on the www.sabotage-skateboards.com website at the time of the order. Prices are indicated inclusive of tax, exclusive of delivery costs, and are governed by French law.

Prices may be modified at any time by the Seller, without prior notice, it being understood however that the price appearing in the catalogue on the day of the order will be the only one applicable to the Buyer.

The items ordered must be paid for in euros and online. Bank charges incurred by the payment shall be borne by the Buyer.

Payment for orders is made exclusively on the website www.sabotage-skateboards.com by credit card (Visa, Mastercard and American Express) or Apple Pay. The site guarantees the security of payment by credit card by using the SSL (Secure Socket Layer) encryption system, thus ensuring the confidentiality and security of the data transmitted, within the framework of an online payment made on the site.

The goods delivered remain the full and complete property of the Seller until full payment has been received, including all taxes and charges.

Invoice

The invoice will be sent to the Buyer at the address indicated at the time of the order. The price is the one in effect at the time of the order by the Buyer. Sabotage Skateboards® disclaims all responsibility for any errors in the customer's information at the time of ordering.

Delivery and transport

Delivery rates are calculated according to the weight of the product and the carrier's rates on the day of the order.

Deliveries are made to the address indicated on the order form, which can only be in the agreed geographical area.

Delivery times are given as an indication only. Exceeding these deadlines may in no case be held against Sabotage Skateboards®, nor give rise to termination of the contract or any compensation for damages. However, if these delays exceed thirty (30) days from the date of the order, the sales contract may be terminated and the Buyer reimbursed by bank transfer for the undelivered goods.

Sabotage Skateboards® may provide the Buyer with the tracking number of his package by e-mail.

The risks are borne by the Buyer from the moment the products are shipped.

The Buyer is obliged to check the condition of the packaging of the goods and their contents on delivery in the presence of the delivery person. In case of damage during transport, any protest must be made to the carrier within three days of delivery.

Conformity and guarantee

All products supplied by Sabotage Skateboards® benefit from the legal guarantee provided by articles 1641 and following of the Civil Code. In the event of non-conformity of a product sold, it may be returned to the Seller who will take it back, exchange it or reimburse it, without however being required to pay damages. All claims, requests for exchange or refund must be made by e-mail within 48 hours of delivery to the following address: hello@sabotage-skateboards.com

This e-mail must contain an explanation of the defect found as well as photos highlighting it.

In the case of an exchange or a refund, the non-conforming product must be returned to Sabotage Skateboards®, using a prepaid return form that will be provided by the Seller.

Right of withdrawal

Pursuant to Article L121-20 of the Consumer Code, the Buyer has a withdrawal period of fourteen (14) working days from the date of receipt of the goods to exercise his or her right of withdrawal and thus return the product to the Seller for exchange or refund without penalty, with the exception of the return costs.

The postmark or the date of the delivery receipt constitutes the starting point of this period. The return or cancellation may concern all or part of the order.

The products must be returned in new condition and in their original packaging for exchange or refund.

The reimbursement, total or partial, is made within thirty (30) days following the receipt by Sabotage Skateboards® of the returned goods. The reimbursement will be made by bank transfer, in accordance with the information provided at the time of the order.

Products returned damaged, incomplete, soiled or without the original packaging will not be returned, exchanged or reimbursed.

After a period of fourteen (14) working days from receipt, the goods will not be taken back, exchanged or refunded.

Personal data

The data provided at the time of the order, allowing the payment of the order and the delivery of the purchased goods, are only requested for the purpose of processing the transaction. In the absence of communication of this data, or in case of erroneous communication, Sabotage Skateboards® cannot be held responsible. In such cases, the Buyer remains liable for payment.

Sabotage Skateboards® undertakes to preserve the confidentiality of information provided by the Buyer, which he/she may be required to transmit for the use of certain services. All information concerning the Buyer is subject to the provisions of the law n° 78-17 of January 6, 1978. As such, the Buyer has the right to access, modify and delete information concerning him/her. Responsability

The Seller, in the process of selling online, is only bound by an obligation of means. The Seller shall not be liable for any damage resulting from the use of the Internet such as loss of data, intrusion, virus, service interruption or other involuntary problems.

Settlement of disputes

The present online sales conditions are subject to French law. For all disputes or litigation, the competent court will be that of Vannes, notwithstanding multiple defendants or the introduction of third parties.

Intellectual property

All the elements of the site www.sabotage-skateboards.com are and remain the exclusive intellectual property of the brand Sabotage Skateboards®. No one is authorised to reproduce, exploit or use in any way whatsoever, even partially, elements of the site, whether in the form of a photo, logo, visual or text.

Applicable law and validity of these general terms of sale

These general terms and conditions of sale are governed exclusively by French law.

The invalidity or inapplicability of one of the clauses of these general terms of sale or of the special terms shall not affect the application or validity of the other clauses of the general terms of sale.
